PinTagGo Terms of Service & End User License Agreement (EULA)

Effective Date: August 5, 2026

Welcome to PinTagGo, operated by EmVi Apps, LLC ("EmVi Apps," "PinTagGo," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the PinTagGo mobile application, website, and related services (collectively, the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use PinTagGo.

By using the App, you represent and warrant that:

  • You are at least 13 years of age.

  • You have the legal capacity to enter into this agreement.

  • You will comply with all applicable laws while using the App.

2. License Grant

Subject to these Terms, EmVi Apps, LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control solely for your personal, non-commercial use and in accordance with the usage rules and policies of the platform from which you downloaded the App, including the Apple App Store and Google Play Store.

This license does not transfer ownership of the App or any intellectual property rights to you.

3. Description of Service

PinTagGo allows users to:

  • Save and organize locations ("pins")

  • Add notes and details to saved locations

  • Share locations with others through the App or external links

  • Connect with friends and view shared content

PinTagGo is not a navigation service and does not provide driving, walking, or other routing directions.

4. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials.

  • All activity that occurs under your account.

  • Providing accurate and current account information.

You agree to notify us immediately of any unauthorized use of your account.

5. Payments & Subscriptions

PinTagGo may offer optional paid subscriptions and features through in-app purchases.

  • Payments are processed exclusively through the Apple App Store or Google Play Store.

  • Subscription pricing, features, and billing periods are displayed within the App before purchase.

  • Unless canceled before the renewal date, subscriptions automatically renew according to the terms of the applicable app marketplace.

  • You are responsible for managing, changing, or canceling your subscriptions through your Apple App Store or Google Play account settings.

  • Subscription renewals, billing, cancellations, and refunds are governed by the policies of the Apple App Store or Google Play Store, as applicable.

  • Except where required by applicable law or marketplace policy, purchases are non-refundable.

6. User Content

You may create or upload content including:

  • Profile photos

  • Saved locations

  • Notes

  • Descriptions

  • Shared links

You retain ownership of your content.

By submitting content through the App, you grant EmVi Apps, LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, and transmit your content solely for the purpose of operating, maintaining, securing, improving, and providing the App.

7. Content Moderation

We reserve the right, but have no obligation, to review, remove, restrict, or disable access to content that violates these Terms or that we reasonably believe is unlawful, harmful, abusive, fraudulent, or otherwise inappropriate.

8. Sharing & Visibility

You understand that:

  • Pins, notes, and other content you intentionally share may be visible to the recipients you select.

  • Shared links may be accessed by anyone who receives the link.

  • You are solely responsible for the content you choose to share.

  • EmVi Apps, LLC is not responsible for how others use or redistribute information you voluntarily share.

9. Acceptable Use

You agree not to:

  • Use the App for unlawful purposes.

  • Upload or share abusive, defamatory, threatening, obscene, or otherwise unlawful content.

  • Harass or impersonate another person.

  • Attempt to gain unauthorized access to the App, servers, databases, or networks.

  • Upload malicious software or interfere with the operation or security of the App.

  • Violate another person's intellectual property or privacy rights.

  • Copy, modify, reverse engineer, decompile, disassemble, redistribute, sublicense, lease, sell, or create derivative works of the App except where expressly permitted by applicable law.

10. Intellectual Property

Except for User Content, the App and all associated software, technology, trademarks, logos, graphics, text, designs, databases, and other materials are owned by EmVi Apps, LLC or its licensors and are protected by applicable intellectual property laws.

No ownership rights are transferred to you through your use of the App.

11. Location Data Disclaimer

PinTagGo allows you to save and share location information.

By using these features:

  • You understand that location information may reveal sensitive personal information.

  • You are solely responsible for deciding what location information to save or share.

  • You assume all risks associated with sharing your location data.

12. Third-Party Services

The App may integrate with third-party services including, but not limited to:

  • Google Maps

  • Firebase

  • Amazon Web Services

These services are governed by their own terms and privacy policies. EmVi Apps, LLC is not responsible for the content, availability, or practices of third-party services.

13. Maintenance & Support

EmVi Apps, LLC is solely responsible for providing maintenance and support for the App, if any.

Nothing in these Terms shall be interpreted as creating any obligation on Apple Inc., Google LLC, or their affiliates to provide maintenance, technical support, or other services relating to the App.

14. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMVI APPS, LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMVI APPS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, OR DAMAGES ARISING FROM THE USE OF SHARED LOCATION INFORMATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

16. Indemnification

You agree to defend, indemnify, and hold harmless EmVi Apps, LLC, its owners, affiliates, employees, contractors, licensors, and service providers from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App.

  • Your content.

  • Your violation of these Terms.

  • Your violation of applicable law or the rights of another person.

17. Apple App Store and Google Play Provisions

If you downloaded the App through the Apple App Store or Google Play Store, you acknowledge that:

  • These Terms are between you and EmVi Apps, LLC, and not Apple Inc., Google LLC, or their respective affiliates.

  • Apple and Google are not responsible for the App, its content, maintenance, support, or warranty obligations.

  • To the extent permitted by law, Apple and Google have no liability arising from your use of the App.

  • Apple and Google's respective marketplace terms and policies continue to apply to your download and use of the App.

  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable provisions of these Terms against you.

18. Termination

We may suspend or terminate your access to the App immediately, with or without notice, if you violate these Terms or if continued access could expose EmVi Apps, LLC or its users to legal, security, or operational risk.

You may stop using the App at any time by deleting your account.

Upon termination:

  • Your license to use the App immediately ends.

  • Certain provisions of these Terms, including ownership, disclaimers, limitation of liability, indemnification, and governing law, will survive termination.

19. Changes to These Terms

We may modify these Terms from time to time.

Material changes will become effective upon posting the updated Terms within the App or on our website.

Your continued use of the App after updated Terms become effective constitutes your acceptance of the revised Terms.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
